LEGAL GUARANTEE OF CONFORMITY OF GOODS

What is it?

Sellers of products are obliged to guarantee to consumers that products are in conformity with the relevant contract of sale.

Therefore, if you are a consumer (according to the Consumer Rights Act 2015), and your product has a defect which existed at the time of delivery, you are entitled to ask:

  1. For the product to be repaired or replaced free of charge within a reasonable period and without major inconvenience to you;

or

  1. For an appropriate reduction made to the price or for the contract to be rescinded:

  • if the product cannot be repaired or replaced,

or

    • if the repair or replacement of the product cannot be done within a reasonable time or without a significant inconvenience to you.

    You may exercise the rights above against the seller from whom you purchased your product. These rights expire six years from delivery of the goods for products purchased in England and Wales, and five years from delivery of the goods for products purchased in Scotland.

    Unless proved otherwise, any lack of conformity which becomes apparent within six months from delivery of the product shall be presumed to have existed at the time of delivery unless this presumption is incompatible with the nature of the product or the nature of the lack of conformity.

    What is the difference between Legal Guarantee and Commercial Guarantee?

    The concept of Commercial Guarantee, such as HyperX warranty, is a guarantee voluntarily provided by the guarantor (either a seller or producer).

    The commercial guarantee does not replace or limit your consumer’s rights under the legal guarantee.

    Consequently, the HyperX Limited Warranty provided with your HyperX product is independent, complementary to and does not affect in any way the Legal

    Guarantee, which you are entitled to and receive from the seller based on your purchase agreement of your HyperX product.
